It’s the kind of nightmare no one ever wants to live through. Julian Fleming, a former Ohio State & Penn State wide receiver, now faces a courtroom instead of the football field. He’s charged with homicide after a crash that killed his girlfriend earlier this year.

Fleming’s attorney, David Bahuriak, isn’t holding back. He told TMZ Sports the case is a “tragic and unavoidable accident,” not a crime.

“The prosecution here took a tragic and unavoidable accident and turned it into a crime when the facts don’t support that,” Bahuriak said. “Julian lost the love of his life, and this prosecution does nothing to advance the interests of anyone.”

Court officials in Bradford County, Pennsylvania, confirmed Fleming is due before a judge Wednesday to face multiple charges, including DUI and aggravated assault by vehicle. The charges stem from a late-May ATV crash that left his girlfriend, 23-year-old Alyssa Boyd, dead at the scene.

According to Pennsylvania State Police, the 24-year-old athlete was driving his ATV on a rural road when a deer darted into his path. The collision threw both Fleming and Boyd from the four-wheeler. Investigators said neither wore safety equipment. Fleming suffered serious injuries, while Boyd didn’t survive.


Bahuriak insists the state’s version of events doesn’t match reality. He argues prosecutors overreached by labeling it a homicide instead of what he calls an “unavoidable tragedy.”

The case has hit the Penn State community hard. Just months ago, Fleming was catching passes for the Nittany Lions after transferring from Ohio State, where he began his college career in 2020. He recorded 14 receptions for 176 yards and a touchdown last season before the accident changed everything.

The crash hit his former teammates hard. Giants linebacker Abdul Carter posted an emotional message online about Boyd’s death, touching fans who followed the couple’s story.

For Julian Fleming, this isn’t just a legal battle, it’s a fight to move through unimaginable grief while defending himself in a case that his lawyer says “never should’ve been filed.”
